Pilot terms of use
These terms apply to the UpscaleFit website and its private online group/class pilot, operated by Upscale Marketing Media (“we”, “us”). Read them together with our privacy notice, fitness disclaimer and participation and risk acknowledgment.
1. Who can participate
The pilot is for people aged 18 or older who can legally accept these terms where they live. Do not join on behalf of a minor. Provide a display name that allows your host to recognize you. Do not impersonate another person.
2. What the service provides
UpscaleFit provides fitness planning, workout recording and optional live metric sharing. Online groups use an internet relay; they are not video classes, emergency monitoring or medical supervision. Access to the native app is currently through the pilot, not a public App Store download offered here.
Features may be incomplete, interrupted or changed during the pilot. Devices, permissions, connectivity and third-party services affect availability and accuracy. Do not rely on the service for a safety-critical decision or as your only record of important information.
3. Your workout and your choices
You decide whether to exercise, what activity and load to use, and when to stop. Follow equipment instructions and seek appropriate professional guidance for your circumstances. A heart-rate target, calculation or prompt is not a medical clearance or a guarantee of a safe intensity. We do not promise weight loss, muscle gain, fitness improvements or any particular result.
4. Private groups and hosts
Guest codes request access; the host approves participants. Keep host access private and share invitations only with intended participants. A display name does not verify someone’s identity or professional qualifications. Hosts must obtain any permissions or qualifications required for the activity they organize and must not represent themselves as medically supervising participants through this service.
Joining does not start your workout or authorize health sharing. Each participant controls their own recording and separately chooses which live metrics to share. Do not pressure others to share, exceed their limits or continue exercising. Do not record, redistribute or publish another participant’s information without an appropriate lawful basis and permission.
5. Acceptable use
Do not harass participants, impersonate others, exploit access codes, bypass approval, probe other people’s sessions, overload the service or upload unlawful content. We may restrict access when reasonably necessary to protect participants or the service, subject to applicable law. Hosts may remove guests or end their session.
6. Ownership and permission to use
UpscaleFit branding, software and original site content are protected by applicable intellectual-property laws. You receive permission to use the pilot as intended, not to copy or resell it. You retain rights in information you provide and permit us to process it only as needed to operate the service as described in the privacy notice. Third-party names and marks belong to their owners; their appearance does not imply sponsorship.
7. Availability, disclaimers and liability limits
To the extent permitted by applicable law, the pilot is provided as available, without a promise of uninterrupted service, error-free metrics or suitability for a particular training goal. To that same extent, we exclude liability for indirect or consequential economic loss caused by service interruption or reliance on unavailable or inaccurate metrics.
These limitations do not exclude or restrict rights or responsibilities that cannot lawfully be limited, including applicable consumer protections, privacy rights, liability for bodily or moral injury, or liability arising from intentional or gross fault. Nothing requires you to waive a non-waivable legal right. This wording is not a blanket release of negligence or a promise that liability is eliminated.
8. Fees, ending access and changes
This website does not take payments or create a paid subscription. Any future paid offering will need separate clear terms before purchase. You may leave a group at any time; sessions expire after two hours. Ending a group does not stop individual Watch recordings. Closing the app completely may require you to join again.
We will date material updates to these terms and request a new acknowledgment where appropriate. Updates do not retroactively remove rights relating to earlier events. Mandatory laws applicable to you remain in effect; these terms do not impose mandatory arbitration or a waiver of collective remedies.
